Portal Ownership

JOVI is the owner of the web portal www.jovi.es (hereinafter, the Portal).

Its address is located at Avda. Bizet nº 39-41, Polígono Industrial Can Jardí de Rubí (Barcelona) (Spain) and it is provided with NIF nº A-08060279. The Owner's registry data are: registered in the Barcelona Commercial Registry, in Book 97, Volume 515, Sheet nº 1297, Folio 53.

The JOVI domain name through which this Portal is accessed is owned by JOVI and its use in connection with content, products or services not owned by JOVI that could cause confusion among end users or discredit JOVI is prohibited.

Purpose

This Legal Notice aims to establish the General Conditions that regulate the access, navigation and use of the aforementioned Portal by all Users. If the User does not agree with them, they will not have the right to use the JOVI website.

JOVI reserves the right to modify or update, at any time, these General Conditions and, in general, the elements that make up the design and configuration of the Portal. Therefore, JOVI recommends that Users carefully read these conditions each time they access the Portal.

The Owner reserves the right to terminate, suspend or interrupt, at any time and without prior notice, access to the products, services and/or Contents of the Portal, as well as the configuration of the Portal itself, services, products, services and Contents, without the possibility for the User to claim or demand any compensation; in particular, due to maintenance, repair, update, improvement and/or adaptation operations to technical, operational and/or legal changes. After such termination, the prohibitions, restrictions and limitations contained in this Legal Notice and/or in any particular conditions that may apply will remain in force.

Portal Access and Use

The User declares that they have the necessary legal capacity to be bound by this agreement and to use this Portal in accordance with the General Conditions set forth herein, which they understand and comprehend in their entirety.

JOVI offers all interested persons and internet users, free of charge, access and general information that appears on this Portal. However, JOVI, S.A. reserves the right to establish services that are subject to payment of a price in the manner determined in the contracting conditions of the service in question; as well as to establish the need for registration to access certain Portal services, in which case registration will be done in the manner expressly indicated in the service and data will be processed only for the purposes and with the guarantees indicated in the form notices. In case of data communication to Jovi, S.A., the user is obliged to provide their own and truthful information in the registration form, being solely responsible for keeping secret the keys and passwords provided to them for such action.

Mere access to the Portal, use of the content offered therein, as well as completion of forms, sending information requests and, in general, any act of a nature similar to the above will imply, on the part of those who navigate the Portal, acquiring the consideration of User and knowledge and acceptance, without reservations, of each and every one of the rules that make up this Legal Notice, in the version published at the time of accessing the website.

The User also declares that all information provided by them in the course of using this Portal is true, complete and accurate.

In any case, access, navigation and use of the Portal is done under the sole and exclusive responsibility of the User, so they commit to observe diligently and faithfully any additional instructions regarding the use of the Portal and its contents. In this sense, the User is obliged to use the Portal contents in a diligent, correct and lawful manner, in accordance with current legislation and, in particular, commits to refrain from:

Using them for purposes or effects contrary to law, morality, generally accepted good customs or public order and instructions received from the Owner.
Using them for purposes harmful to the legitimate rights of third parties.
Using the contents and, in particular, information of any kind obtained through the Portal to send advertising, communications for direct sales purposes or any other kind of commercial purpose, unsolicited messages directed to a plurality of people regardless of their purpose, as well as refraining from marketing or disclosing such information in any way.

Intellectual and industrial property

All Portal contents, understanding by these, purely by way of example and not exhaustive, texts, photographs, graphics, images, icons, technology, navigation structure, software, audiovisual or sound content, graphic design and source codes, indexes, trademarks, logos, expressions and information and, in general, any other creation protected by national regulations and international treaties on intellectual and industrial property (hereinafter the contents) are intellectual property of JOVI or third parties, from whom JOVI has obtained the corresponding license.

All intellectual and industrial property rights over the Contents are reserved, giving rise to responsibilities for unauthorized use, exploitation or utilization of the contents.

This notice does not, in any case, entail assignment of rights in favor of the user in relation to any integral element of the Portal or the contents and services offered. Therefore, copying, public communication, distribution, marketing or any other activity with advertising intent that may be carried out with any of the website contents is prohibited, as long as there is no consent from Jovi, S.A., which must be express and written.

Therefore, the user may view the different website contents, print them and store them as long as it is, solely and exclusively, for their personal use.

The use of trademarks, trade names or distinctive signs owned by the Owner or third parties is also prohibited, without prior written consent from their Owner.

User registration

Use of the Portal does not require prior user registration, which may be required for certain services, present or future, such as participation in contests or newsletter subscription, without prejudice to any others that may be established. In each case, the form and manner of registration will be expressly indicated.

In any case, the required data will be essential to offer the services in question, with JOVI guaranteeing the adoption of adequate measures to achieve the security and integrity legally provided for each type of file, as well as their confidentiality.

Given the typology of products that JOVI markets, as well as possible advertising promotion through contests, to use services where registration is necessary, minors must obtain permission from their parents, guardians or legal representatives, who will in all cases be responsible for acts committed by them, with JOVI recommending the use of filtering and blocking mechanisms and software that allow limiting available content, if considered inappropriate for minors.

JOVI guarantees the protection of minors regarding the contents and services of its website, in service of cultural diffusion.

Contests

In case the user wants to participate in a contest or promotional campaign contained on the website, they must previously accept the participation conditions, which will be visible at all times for study and examination. In any case, acceptance will be understood with effective participation in the contest or promotion in question.

Newsletter subscription

In case the user wants to subscribe to newsletters, which will always be voluntary, the act of registering will mean acceptance of the conditions for supplying said newsletters, including authorization to JOVI for sending this type of communications, according to applicable legislation on the matter.

Owner responsibilities

The Owner declares that it has adopted all necessary and reasonable measures, within its possibilities and the state of technology, to guarantee the Portal's operation and avoid the existence and/or transmission of viruses and other harmful components to Users.

Likewise, the Owner will put all reasonable means at its disposal to verify the veracity, accuracy, adequacy, suitability, completeness and currency of the information and contents provided on the Portal.

Warranty exclusion

The User expressly recognizes and accepts that the Owner grants no warranty of any kind, whether express or implied, on the reliability, usefulness or accuracy of information published and/or provided on the Portal in relation to JOVI's products and/or services.

In particular, JOVI does not guarantee nor is responsible for:

Lack of availability or accessibility of the Portal or continuity of Portal contents;
The existence of interruptions, errors in Portal access or Portal malfunction, as well as technical problems or failures that occur during Internet connection;
The absence of viruses and other harmful computer elements on the Portal or server that supplies it; It is the User's responsibility, where appropriate, to have adequate means for detecting or disinfecting harmful computer programs.
The invulnerability of the Portal and security measures adopted therein;
The non-existence of errors in contents;
Suitability for a particular purpose or end of the Portal and information published and/or provided in relation to JOVI's products or services;
Decisions made based on information provided on the Portal, nor damages to the User or third parties due to actions based solely on information obtained from the portal.
Damage produced to users' or third parties' computer equipment during Portal service provision.
Any other damages that may be caused by defective Portal operation.

Links to other websites

The Owner may offer on its Portal links, directly or indirectly, to Internet resources or web pages that are outside the Portal. In no case should these links presuppose that there are agreements with their managers, nor JOVI's recommendation for contracting products and/or services offered.

The Owner does not have the faculty or human or technical means to know, control or approve all the information, content, products or services provided by other web pages to which links may be established from the Portal. Consequently, the Owner cannot assume any type of responsibility for any aspect related to the web pages to which a link could be established from the Portal, specifically, by way of example and not exhaustive, on their operation, access, data, information, files, quality and reliability of their products and services, their own links and/or any of their contents, in general.

Links to this portal

In the event that any User, entity or web page wishes to establish any type of link to the Portal, prior to making said link they must obtain express and written authorization from the Owner and the link must be absolute and complete, in the sense that it is made to the main page of JOVI, S.A., covering the entire extension of the Portal's main page.

In the event that the entity that makes the link from its web page to the JOVI Portal also wishes to include on its web page the trademark, denomination, trade name, sign, logo, or any other identifying sign of the Owner and/or the Portal, it will need prior express and written authorization from JOVI.

Nullity

In the event that any provision of this Legal Notice is considered null, in whole or in part, such nullity or inapplicability will not affect the other provisions of the Legal Notice or the particular conditions that, where appropriate, may have been established.

In the event that the Owner does not exercise any right or action recognized in this Legal Notice, this will not constitute a waiver thereof, except for recognition and agreement that must be in writing on their part.

Applicable legislation and competent courts

This Legal Notice will be governed by Spanish regulations. For the resolution of any conflict that could arise from access to the Portal, the User and the Owner with express waiver of any other jurisdiction, agree to expressly submit to the Courts and Tribunals of the city of the Owner's domicile of the Portal
